Protecting your private information is our priority. This Privacy Policy applies to www.tutormeeducation.com (the “Website”), the Tutor Me Education platform (the “Platform”), and all related services (collectively, the “Services”) operated by Tutor Me LA LLC dba Tutor Me Education (“Tutor Me Education,” “Company,” “we,” “us,” or “our”). This Privacy Policy governs our collection, use, storage, sharing, and protection of your personal information.
By accessing or using our Website, Platform, or Services, you consent to the data practices described in this Privacy Policy. If you do not agree with these practices, please do not use our Services. If you are a parent or legal guardian consenting on behalf of a minor, you accept this Privacy Policy on the minor’s behalf.
This Privacy Policy should be read in conjunction with our Terms of Service, which are available at https://tutormeeducation.com/terms-of-use/.
- Information We Collect
We collect information in several ways depending on how you interact with the Services and your role (Client, parent/guardian, student, or Instructor).
- Information You Provide Directly.
- Account Information: name, email address, phone number, mailing address, date of birth, and account credentials.
- Client/Parent Information: parent or guardian name, contact information, student name(s), student age and grade level, school name, academic needs and goals, and scheduling preferences.
- Instructor Information: name, contact information, educational qualifications, certifications, teaching experience, subject expertise, resume or CV, Social Security Number or EIN (for tax reporting), bank account information (for payment processing), state of residence, and professional references.
- Payment Information: billing name, credit or debit card number, expiration date, CVV, and billing address. Payment information is processed through our third-party payment processors and is not stored on our servers in unencrypted form.
- Student Information: student name, age, grade level, school, academic records, assessment results, learning plans, individualized education program (IEP) information where applicable, progress reports, and session notes.
- Communications: messages, emails, and other communications sent through the Platform, including communications between Clients and Instructors.
- Background Check Information: information provided in connection with background checks, including criminal history results, identity verification, and related screening data, collected through our third-party background check providers.
- Information Collected Automatically.
- Device and Connection Information: IP address, browser type and version, operating system, device type, unique device identifiers, screen resolution, and language preferences.
- Usage Information: pages visited, features used, links clicked, time spent on pages, search queries within the Platform, referral URLs, and navigation paths.
- Session Recordings: audio, video, screen captures, and transcripts of tutoring sessions conducted through the Platform, as described in our Terms of Service. Session recordings may be made on a routine or selective basis.
- Log Data: access times, error logs, and system activity logs.
- Location Data: approximate geographic location based on IP address. We do not collect precise GPS location data.
- Information from Third Parties.
- School Districts and Agencies: student rosters, demographic data, academic records, IEP data, and other information provided by school districts, regional centers, and educational agencies under data-sharing agreements.
- Background Check Providers: criminal history results, sex offender registry checks, identity verification, and related screening results.
- Payment Processors: transaction confirmations, payment status, and fraud-detection data.
- How We Use Your Information
We use the information we collect for the following purposes:
- Service Delivery. To operate the Platform, match Clients with Instructors, facilitate scheduling and communication, process payments, deliver tutoring and related services, and provide customer support.
- Quality Assurance and Safety. To monitor, review, and evaluate tutoring sessions (including through session recordings) for quality assurance, training, safety, compliance with our policies and applicable law, and investigation of complaints or safety incidents.
- Compliance and Reporting. To fulfill our obligations under agreements with school districts, regional centers, and other institutional partners, including progress reporting, outcome measurement, attendance tracking, and compliance with FERPA, COPPA, and state student-data protection laws.
- Background Checks. To facilitate background checks on Instructors as required by applicable law, client requirements, or Company policy.
- Billing and Payments. To process transactions, send invoices, issue refunds, and manage billing disputes.
- Communications. To send you account notifications, service updates, appointment reminders, and other transactional communications. With your consent where required, to send you marketing communications about our Services, from which you may opt out at any time.
- Platform Improvement. To analyze usage patterns, diagnose technical problems, improve the Platform and Services, develop new features, and conduct research and analytics.
- Legal and Safety. To comply with applicable laws, respond to legal processes, enforce our Terms of Service, protect the rights, safety, and property of Company, our Users, students, and the public, and prevent fraud, abuse, and security threats.
- Tax Reporting. To prepare and file tax documents, including IRS Forms 1099, as required by applicable tax law.
- Session Recordings
- What We Record. As described in our Terms of Service, we may record, monitor, and store audio, video, screen captures, and transcripts of tutoring sessions conducted through the Platform. Recordings may be made on a routine, automated basis or on a selective basis at our discretion.
- How Recordings Are Used. Session recordings may be used for quality assurance, investigation of complaints or safety incidents, verification of session occurrence and duration for billing purposes, training and Platform improvement, compliance with institutional partner requirements, and legal defense.
- Who Has Access. Session recordings may be accessed by authorized Company personnel, and where required, by the school district, agency, or institutional partner under whose agreement the session was conducted. Recordings are not shared with other Clients, Instructors, or third parties except as described in this Privacy Policy or as required by law.
- Retention. Session recordings are retained in accordance with our data retention schedule set forth in Section 8, applicable law, and the requirements of our institutional partners.
- Consent. By using the Services, you consent to session recording as described in our Terms of Service. Instructors provide separate consent through their Independent Contractor Agreement or employment agreement. Parents and guardians consent on behalf of minor students by accepting the Terms of Service.
- How We Share Your Information
Tutor Me Education does not sell, rent, or lease your personal information to third parties for their marketing purposes. We may share your information in the following circumstances:
- With Instructors. We share limited Client and student information (such as student name, grade, subject needs, and scheduling information) with Instructors matched to provide services. Instructors are bound by confidentiality and data protection obligations under their agreements with Company.
- With School Districts and Institutional Partners. We share student data, session data, progress reports, attendance records, and related information with school districts, regional centers, and other institutional partners as required under our agreements with those partners and in compliance with FERPA and applicable law.
- With Service Providers. We share information with third-party service providers who perform services on our behalf, such as payment processing, background checks, data hosting, email delivery, customer support, and analytics. These providers are contractually required to protect your information, use it only for the specific services provided, and comply with applicable data protection laws. Our current categories of service providers include:
- Payment processors (for billing and payroll)
- Background check providers (for Instructor screening)
- Cloud hosting and data storage providers
- Communication and email service providers
- Analytics and performance monitoring tools
- Customer relationship management (CRM) systems
- For Legal and Safety Purposes. We may disclose your information when we believe in good faith that disclosure is necessary to: (a) comply with applicable law, regulation, court order, subpoena, or legal process; (b) protect the rights, safety, or property of Company, our Users, students, or the public; (c) investigate or prevent fraud, security threats, or illegal activity; (d) enforce our Terms of Service; or (e) respond to a government or regulatory request.
- Business Transfers. In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your personal information may be transferred to the acquiring entity. We will notify you of such a transfer and any choices you may have regarding your information.
- With Your Consent. We may share your information with third parties when you have provided explicit consent.
- Aggregated or De-Identified Data. We may share aggregated or de-identified data that cannot reasonably be used to identify you for research, analytics, marketing, or other business purposes.
- Student Data Protections
- FERPA Compliance. Tutor Me Education may receive student education records from school districts and educational agencies that are subject to the Family Educational Rights and Privacy Act (“FERPA”), 20 U.S.C. § 1232g. When we act as a “school official” with a legitimate educational interest under a data-sharing agreement with a school district or educational agency, we agree to: (a) use education records solely for the purposes authorized by the disclosing institution; (b) not re-disclose education records to third parties without proper authorization or as permitted by FERPA; (c) maintain reasonable administrative, technical, and physical safeguards to protect education records; and (d) return or destroy education records when no longer needed for the authorized purpose, or upon request by the disclosing institution.
- COPPA Compliance. Tutor Me Education does not knowingly collect personal information directly from children under the age of thirteen (13) without verifiable parental consent as required by the Children’s Online Privacy Protection Act (“COPPA”), 15 U.S.C. §§ 6501-6506. Where we collect information about children under 13, we do so through the parent or guardian’s account or through a school district acting under FERPA’s “school official” exception. If you are a parent or guardian and believe that your child under 13 has provided personal information to us without your consent, please contact us at [email protected]. We will promptly investigate and, if appropriate, delete such information.
- State Student Privacy Laws. To the extent applicable, we comply with state student-data protection laws, including but not limited to the California Student Online Personal Information Protection Act (SOPIPA), Business and Professions Code §§ 22584-22585, and the New York Education Law § 2-d.
- No Student Data Monetization. We do not sell student data. We do not use student data for targeted advertising. We do not create advertising or non-educational profiles of students. We do not use student data for any purpose other than providing and improving the educational services for which the data was collected.
- Parental Rights. Parents and legal guardians have the right to review the personal information we have collected about their child, request corrections, and request deletion, subject to applicable law and our contractual obligations. To exercise these rights, contact us at [email protected].
- Cookies and Tracking Technologies
- What Are Cookies. Cookies are small data files placed on your device by our web servers. They help us recognize your browser, remember your preferences, and improve your experience.
- Types of Cookies We Use.
- Essential Cookies: required for the operation of the Website and Platform, such as session management and authentication. These cannot be disabled.
- Analytics Cookies: help us understand how Users interact with our Website and Platform, including pages visited, time spent, and navigation paths. We may use tools such as Google Analytics for this purpose.
- Functional Cookies: remember your preferences and settings (such as language or region) to personalize your experience.
- Marketing Cookies: used to deliver relevant advertisements and track the effectiveness of our marketing campaigns. We do not use marketing cookies to track students.
- Your Cookie Choices. Most web browsers are set to accept cookies by default. You can modify your browser settings to decline cookies or alert you when a cookie is being placed. - Do Not Track. Some browsers include a “Do Not Track” (DNT) signal. There is no universally accepted standard for how to respond to DNT signals. At this time, we do not respond to DNT signals, but we do not track Users across third-party websites for advertising purposes.
- No Student Tracking for Advertising. We do not use cookies or tracking technologies to build advertising profiles of students or to target advertising to students.
- Security of Your Personal Information
- Security Measures. Tutor Me Education implements reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, use, disclosure, alteration, and destruction. Our security measures include:
- Encryption of sensitive data in transit using SSL/TLS protocols;
- Encryption of sensitive data at rest where technically feasible;
- Access controls limiting access to personal information to authorized personnel on a need-to-know basis;
- Regular security assessments and monitoring;
- Employee and contractor training on data protection and confidentiality obligations;
- Contractual data protection requirements for third-party service providers.
- No Absolute Security. While we strive to protect your personal information, no method of electronic storage or transmission is completely secure. We cannot guarantee absolute security and are not responsible for the unauthorized acts of third parties.
- Your Responsibilities. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. Please notify us immediately at [email protected] if you become aware of any unauthorized use of your account.
- Data Retention
- Retention Periods. We retain personal information for as long as necessary to fulfill the purposes for which it was collected, comply with our legal obligations, resolve disputes, and enforce our agreements. General retention periods include:
- Account Information: retained for the duration of the account relationship and for a period of three (3) years after account termination, unless a longer retention period is required by law.
- Student Education Records: retained in accordance with FERPA, applicable state law, and our agreements with the disclosing institution. Upon request by the disclosing institution, we will return or destroy such records.
- Session Recordings: retained for a minimum of one (1) year and a maximum of five (5) years after the date of the recording, unless a longer retention period is required by law, institutional partner agreement, or ongoing legal proceedings.
- Financial and Tax Records: retained for seven (7) years as required by applicable tax and financial reporting laws.
- Background Check Results: retained for the duration of the Instructor’s active engagement with the Platform and for one (1) year thereafter, or as required by applicable law.
- Deletion. When personal information is no longer needed for any lawful purpose, we will securely delete or de-identify it in accordance with our data retention and destruction procedures.
- Data Breach Notification
In the event of a data breach that compromises the security of your personal information, we will:
- Promptly investigate and take reasonable steps to contain and remediate the breach;
- Notify affected individuals as required by applicable federal and state breach notification laws, including the California Civil Code §§ 1798.29 and 1798.82;
- Notify affected school districts and institutional partners as required by our agreements and applicable student-data protection laws;
- Notify applicable regulatory authorities as required by law;
- Provide information about the nature of the breach, the types of data affected, and steps individuals can take to protect themselves.
- Your Rights and Choices
- Access and Correction. You may access and update your personal information by logging into your account. If you need assistance, contact us at [email protected].
- Deletion. You may request deletion of your personal information by contacting us at [email protected]. We will comply with your request subject to applicable legal obligations, contractual requirements, and legitimate business needs. Note that some information may need to be retained for legal, tax, or compliance purposes.
- Opt-Out of Marketing. You may opt out of receiving marketing and promotional communications from us at any time by: (a) clicking the “unsubscribe” link in any marketing email; (b) contacting us at [email protected]; or (c) adjusting your communication preferences in your account settings. Note that even if you opt out of marketing communications, we may still send you transactional and service-related communications.
- Mobile and SMS Communications. If you have opted into receiving SMS or text messages from us, you may opt out at any time by replying “STOP” to any message or by contacting us. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third party.
- California Privacy Rights
- CCPA/CPRA Rights. If you are a California resident, you may have additional rights under the California Consumer Privacy Act (“CCPA”) as amended by the California Privacy Rights Act (“CPRA”), Cal. Civ. Code §§ 1798.100-1798.199.100, including:
- Right to Know: the right to request information about the categories and specific pieces of personal information we have collected, the purposes for collection, and the categories of third parties with whom we share it.
- Right to Delete: the right to request deletion of your personal information, subject to certain exceptions.
- Right to Correct: the right to request correction of inaccurate personal information.
- Right to Opt-Out of Sale/Sharing: the right to opt out of the sale or sharing of your personal information. Note: Tutor Me Education does not sell personal information.
- Right to Non-Discrimination: the right not to be discriminated against for exercising your privacy rights.
- How to Exercise Your Rights. To exercise any of these rights, contact us at [email protected] or 877-500-0818. We will verify your identity before processing your request. You may also designate an authorized agent to submit a request on your behalf.
- Response Timing. We will respond to verifiable consumer requests within forty-five (45) days as required by law. If additional time is needed, we will notify you of the extension and the reason.
- California “Shine the Light” Law. Under California Civil Code § 798.83, California residents may request information about our disclosure of personal information to third parties for their direct marketing purposes. As stated above, we do not disclose personal information to third parties for their direct marketing purposes.
- Student Data Exemption. Certain student data governed by FERPA, COPPA, or other education-specific privacy laws may be exempt from some CCPA/CPRA provisions. We will identify and apply applicable exemptions as required by law.
- Children’s Privacy
Tutor Me Education is committed to protecting the privacy of children. Our Platform is designed to provide educational services to students of all ages, including children under 13.
- Parental Consent. We do not knowingly collect personal information directly from children under thirteen (13) without verifiable parental consent. Information about students under 13 is collected through the parent or guardian’s account, or through a school district or educational agency acting under FERPA’s “school official” exception.
- Limited Use. We use children’s personal information solely for the purpose of providing the educational services requested and do not use it for advertising, marketing, or building non-educational profiles.
- Parental Access. Parents and guardians may review the personal information we have collected about their child, request corrections, and request deletion by contacting us at [email protected].
- Inadvertent Collection. If we learn that we have collected personal information from a child under 13 without verifiable parental consent and not under a FERPA school official exception, we will promptly delete such information. If you believe this has occurred, please contact us immediately.
- Data Transfers
Your personal information may be processed and stored in the United States and in other countries where our service providers operate. If your information is transferred outside your country of residence, we take steps to ensure that appropriate safeguards are in place to protect your information in accordance with applicable law. By using the Services, you consent to the transfer of your information to the United States and other jurisdictions as described in this Privacy Policy.
- Third-Party Links and Services
Our Website and Platform may contain links to third-party websites, applications, or services that are not operated by us. We are not responsible for the privacy practices or content of those third-party services. We encourage you to review the privacy policies of any third-party websites you visit. This Privacy Policy applies only to information collected by Tutor Me Education through our Website, Platform, and Services.
- Changes to This Privacy Policy
Tutor Me Education may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors.
